These terms and conditions set out the rules for making purchases from the online shop operated by the Seller at https://bigloveset.com.

§1 Definitions
1. Regulations – these regulations of the online shop.
2. online shop – the website at https://bigloveset.com through which the Customer may place an Order.
3. Seller – the entity providing sales services through the Online Store under the terms of these Terms and Conditions.
4. Business Days – one day from Monday to Friday excluding public holidays.
5. Customer – a natural person, legal person or organisational unit without legal personality but having the capacity to perform legal acts, who under the terms of these Regulations places an Order in the Online Store.
6. Consumer – a customer who is a natural person using the Online Store for the purpose not directly related to his/her business or professional activity.
7. object of transaction – Goods listed and described on the website of the Online Store.
8. Merchandise – movable item, presented in the Online Store, to which the Sales Agreement pertains. 9) Sales Agreement – a sales agreement.
9. Sales Agreement – a contract of sale of Goods, as defined by the Civil Code, concluded between the Seller and the Customer, using the website of the Online Store. 10.
10. Order – the Customer’s declaration of will specifying unambiguously the type and quantity of Goods, aiming directly at concluding the Sales Agreement. 11.
11. Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended).
§2 General principles
1. These Terms and Conditions define the rules for the use of the On-line Store available at https://bigloveset.com.
2. It is a condition of placing an Order at the Online Store that the Customer is familiar with these Terms and Conditions and accepts their provisions during the fulfilment of the Order.
3. The Seller conducts retail and wholesale sales and accepts specialised Orders for fulfilment via the Online Shop.
4. The Seller shall provide information about the Goods in the Online Store.
5. All Goods offered in the Online Store are brand new, originally packaged, free from physical and legal defects and have been legally introduced into the Polish market.
6. In order to place an Order at the Online Store, the Customer must meet the following technical requirements necessary to cooperate with the tele-information system used by the Seller:
1) have an electronic mail (e-mail) account.
2) have a computer, smartphone or tablet with an operating system: Windows, Mac OS X, Linux or Android.
3) Have a web browser of the following version or higher installed: Internet Explorer – version 9, Chrome – version 46, Safari – version 8, Firefox – version 41, Opera – version 32.
7. The Customer is obliged to use the Online Store in a manner consistent with the law and good practice, taking into account respect for personal rights and copyrights, property rights and intellectual property of the Seller and third parties.
8. The Customer is obliged not to provide content prohibited by law.
§3 Prices
1. All prices given in the Online Shop are gross prices given in Polish zloty (including all applicable taxes).
2. To the price of the Goods shall be added the costs of delivery in the amount indicated in §6 for the method of delivery chosen by the Customer.
§4 Placing orders
1. Orders are accepted by the Seller via the On-line shop.
2. Orders may be placed at the On-line shop 24 hours a day, 7 days a week throughout the year.
3. Placing an Order involves completing an order form in the Online Store.

4. An order is effective if the Customer duly fills in the order form and correctly enters contact details: exact address to which the Order is to be sent, and telephone number and e-mail address.
5. In the event that the data provided is not complete, the Seller will contact the Customer. If it is not possible to contact the Customer, the Seller has the right to cancel the Order.
6. The Customer receives a fiscal receipt in the process of ordering or may wish to receive a VAT invoice. The document will be sent with the shipment or will be sent to the Customer’s e-mail address provided in the Order.
7. After the Customer has successfully placed an Order, the Customer will receive an automatic response from the shop confirming receipt of the Order.
8. Completion of the Order shall commence upon payment by the Customer or, if the Customer has chosen the option of payment on delivery of the Goods, upon submission of the Order.
9. In the event that the ordered Goods are out of stock, the Seller shall inform the Customer of this fact and the related extension of the processing time of the Order immediately, within 48 hours at the latest.
10. The sales contract is concluded in the Polish language.
11. The Internet Shop conducts sales in Poland and the European Union.
§5 Payment methods for the Order
1. The Seller shall make available to the Customer the following methods of payment for the Sales Agreement:

§6 Cost, methods and date of delivery
1. an order is sent to the address indicated in the order form. The Customer will be informed immediately if the order form is incorrectly filled in, which prevents or delays the shipment.
2. The Seller provides the Customer with the following delivery methods:
InPost parcel machines
InPost courier
International shipment – usually DPD
3. The total order processing time is a maximum of 30 days from the day of placing the order by the Customer, however the Online Store makes every effort to ensure that orders are processed as quickly as possible. The order processing time starts from the moment the funds are credited to the seller’s account or from the moment of relevant information from the e-payment operator.
The customer is charged for delivery:
1. 18 zł Parcel Post InPost
2. 20 PLN InPost courier
4. The period for delivery of the Goods to the Customer is 14-21 Business Days, unless a different period is specified in the description of the Goods.
§7 Withdrawal from the contract
1. A consumer who has entered into a remote contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs.
2. To meet this deadline it is sufficient to send a statement before its expiry to the address of the Seller.
3. A sample withdrawal form is available on the website of the Online Store under the tab “Withdrawal from the contract” and is attached to the e-mail with confirmation of the Order.

4. The consumer may use the model form, but it is not obligatory.
5. The Consumer is obliged to return the Goods to the Seller immediately, no later than within 14 calendar days from the date of withdrawal from the contract.
6. To meet the deadline it is sufficient to return the Goods before its expiry. The Consumer may return the Goods to the Seller’s address.
7. The consumer shall bear the direct costs of returning the Goods in connection with the withdrawal from the contract.
8. In the event of withdrawal from the contract the Consumer shall be refunded all payments received from him (no later than within 14 calendar days), including delivery costs.
The exception is when the Consumer has chosen a method of delivery other than the cheapest available in the Online Shop. In such a situation the Consumer shall bear the delivery costs.
The Seller shall refund the payment using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of refund that does not involve any costs for the Consumer.
9. The consumer shall be liable for any diminution in the value of the Goods resulting from their use beyond what is necessary to ascertain the nature, characteristics and functioning of the Goods.
10. The Seller reserves the right to consider individually each withdrawal from the contract due to the fact that, in accordance with Article 38 of the Act on Consumer Rights, the right to withdraw from the contract concluded off-premises or at a distance shall not be entitled to the consumer in respect of contracts in which the subject of performance is a non-refabricated item, produced to the consumer’s specifications or serving to meet his individual needs.
11. You may not withdraw from the contract in the case of the purchase of products from the category “bargains, sales ” and the sale of products at a reduced price.
§8 Complaint procedure
The Seller is obliged to deliver the Goods to the Customer without any defects, unless the Goods come from the category “Bargains” and have a slight defect, about which there is information in the product description. I throw into the bargain items that are not perfect, where during the sewing process, for example, something changes the shape slightly or sews the label crookedly.
2. The basis and extent of the Seller’s liability to the Customer is determined by generally applicable law, in particular the Civil Code.
3. The Seller is responsible to the Customer if the goods have a physical or legal defect (warranty).
4. Complaints may be filed by the Customer for example:

5. It is recommended that the Customer provide the following details in the description of the complaint:
Name.
Address.
E-mail address.
Date of order.
The subject of the complaint, indicating the request.
All circumstances justifying the complaint.

6. The Customer will be informed of the outcome of the complaint by e-mail or post.
7. Complaint must be submitted to the Seller with the advertised product and proof of purchase (receipt or invoice).
8. If, due to the nature of the product, delivering it by the Customer would be excessively difficult, the Customer is obliged to make the product available to the Seller at the place where the product is located.
9. The Seller shall respond to the Customer’s complaint immediately, no later than within 14 calendar days from the date of its submission. Failure of the Seller to respond within this period means that the Seller considered the complaint as justified. 10.
10. In the case of considering the complaint in favour of the Customer, the Seller shall repair or replace the advertised goods with new, full-value goods or return the value of the purchased Goods.
11. It is mentioned that each complaint is considered individually, and in the case of custom-made products that are without defects, it is stipulated that the complaint will not be taken into account due to Article 38 point 3 of the Consumer Rights Act of 30 May 2014.
12. Products purchased from the category “Bargains, sales and discounted products” are not subject to complaints and returns.
§9 Out-of-court ways of dealing with complaints and claims
1. The customer who is a consumer has, inter alia, the following possibilities to use out-of-court ways of dealing with complaints and pursuing claims, including:
The consumer shall be entitled to apply to a permanent amicable consumer court with a request to resolve a dispute arising from the concluded sales agreement operating at the Trade Inspection.
2. The Consumer shall be entitled to apply to the provincial inspector of the Commercial Inspection to initiate mediation proceedings for the amicable settlement of the dispute between the Consumer and the Seller.
3. The Consumer may obtain free assistance in resolving a dispute between the Consumer and the Seller, also using free assistance of a county (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (such as the Consumer Federation, Polish Consumers Association). §10 Final provisions
1. A Customer who has an account with the Online Shop will be informed of changes to the Terms and Conditions by email correspondence.
2. a Customer who does not accept the changes to the Terms and Conditions, has the right to delete his/her account at any time.
3. Orders placed by the Customer before the amendments to the Terms and Conditions became effective will be processed in accordance with the previous provisions of the Terms and Conditions.
4. Matters not covered by these Terms and Conditions shall be governed by generally applicable provisions of Polish law, in particular: Civil Code, Act on Provision of Electronic Services, Act on Consumer Rights and other relevant provisions of commonly binding law.
5. Disputes arising from the application of these Terms and Conditions and in connection with the performance of contracts concluded between the Seller and the Customers shall be considered by the competent court according to the provisions of the material and local jurisdiction in accordance with the Civil Procedure Code Act of 17.11.1964.
6. The administrator of personal data processed in connection with the implementation of these Terms and Conditions is the Seller. Personal data shall be processed only for the purpose of issuing an invoice, bill or financial reporting. Providing personal data is voluntary. Any person whose personal data is processed by the Seller shall have the right to inspect its content and the right to update and correct it.
